1. Agreement to Terms

Welcome to Hi To Holidays. By accessing or using our website, mobile application, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our Services.

These Terms constitute a legally binding agreement between you and Hi To Holidays ("Company," "we," "us," or "our").

2. Services Overview

Hi To Holidays provides travel booking and planning services, including but not limited to:

  • Group tour packages and customized travel itineraries
  • Hotel and accommodation bookings
  • Transportation arrangements
  • Travel consultation and planning assistance
  • Activity and excursion bookings
  • Travel documentation support

3. User Accounts and Registration

3.1 Account Creation

To access certain features of our Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 18 years old to create an account and use our Services. By creating an account, you represent that you meet this age requirement.

4. Booking and Reservations

4.1 Booking Process

When you make a booking through our Services, you agree to pay all applicable charges, including taxes and fees. All bookings are subject to availability and confirmation.

4.2 Pricing and Payment

  • All prices are quoted in Indian Rupees (INR) unless otherwise specified
  • Prices are subject to change without prior notice
  • Payment must be made in full as per the payment schedule provided
  • We accept payment via credit/debit cards, net banking, UPI, and bank transfers
  • Additional charges may apply for payment processing

4.3 Confirmation

Your booking is confirmed only upon receipt of full payment and issuance of a confirmation email. We reserve the right to cancel any booking if payment is not received by the specified deadline.

5. Cancellation and Refund Policy

5.1 Cancellation by Customer

Cancellation charges apply as follows:

  • More than 45 days before departure: 25% of total booking amount
  • 30-45 days before departure: 50% of total booking amount
  • 15-29 days before departure: 75% of total booking amount
  • Less than 15 days before departure: 100% of total booking amount (no refund)

Peak season, special events, and certain packages may have different cancellation policies, which will be clearly communicated at the time of booking.

5.2 Cancellation by Company

We reserve the right to cancel any booking due to:

  • Insufficient bookings for a group tour
  • Force majeure events (natural disasters, political unrest, pandemics, etc.)
  • Government restrictions or travel advisories
  • Safety concerns

In such cases, we will provide a full refund or offer an alternative travel date/destination.

5.3 Refund Processing

Approved refunds will be processed within 15-30 business days to the original payment method.

6. Travel Documents and Requirements

6.1 Customer Responsibility

You are responsible for:

  • Obtaining valid passports, visas, and other travel documents
  • Meeting health requirements (vaccinations, medical certificates)
  • Complying with customs and immigration regulations
  • Ensuring travel documents are valid for at least 6 months beyond travel dates
  • Obtaining necessary travel insurance

6.2 Company Assistance

While we provide guidance and support for travel documentation, the ultimate responsibility lies with the traveler. We are not liable for any issues arising from incomplete or incorrect documentation.

7. Travel Insurance

We strongly recommend purchasing comprehensive travel insurance covering:

  • Trip cancellation and interruption
  • Medical emergencies and evacuation
  • Lost or delayed baggage
  • Personal accident coverage
  • COVID-19 related coverage

We can assist in arranging travel insurance, but you are responsible for reviewing and understanding the policy terms.

8. Limitation of Liability

8.1 Service Provider Liability

Hi To Holidays acts as an intermediary between travelers and service providers (hotels, airlines, tour operators, etc.). We are not liable for:

  • Acts or omissions of third-party service providers
  • Delays, cancellations, or changes by airlines, hotels, or other vendors
  • Loss, damage, or injury caused by service providers
  • Quality or standard of services provided by third parties

8.2 Force Majeure

We are not responsible for any failure to perform obligations due to circumstances beyond our reasonable control, including:

  • Natural disasters (earthquakes, floods, hurricanes)
  • War, terrorism, or civil unrest
  • Government actions or travel restrictions
  • Pandemics or health emergencies
  • Transportation failures or strikes

8.3 Maximum Liability

Our total liability for any claim arising from your use of our Services shall not exceed the total amount paid by you for the specific booking in question.

9. User Conduct

You agree not to:

  • Use our Services for any unlawful purpose
  • Provide false or misleading information
  • Interfere with or disrupt our Services or servers
  • Attempt to gain unauthorized access to our systems
  • Harass, abuse, or harm other users or our staff
  • Use automated systems to access our Services without permission
  • Reproduce, duplicate, or copy any part of our Services without consent

10. Intellectual Property

All content on our Services, including text, graphics, logos, images, and software, is the property of Hi To Holidays or its licensors and is protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission.

11. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy. By using our Services, you consent to our collection and use of personal information as described in the Privacy Policy.

12. Dispute Resolution

12.1 Complaints

If you have any complaints or concerns, please contact us immediately. We will make reasonable efforts to resolve the issue promptly.

12.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

12.3 Jurisdiction

Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts in Udaipur, Rajasthan, India.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on our website. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hi To Holidays regarding the use of our Services.
